Terms and Conditions

These terms and conditions specify the contractual relationship between coach Barbora and the client.

Clients agreement with Barbora arises from the purchase of any online and personal fitness services provided by Barbora, which are: nutrition program, training program, bikini competition preparation, body change program, personal training, group session, posing session, consultations, online webinars and workshops.  

These terms constitute a legal agreement between Barbora and client, so please make sure you read and understand them carefully.

WholeLifeFit Barbora 

Barbora is a qualified fitness nutrition specialist and fitness trainer providing online and personal fitness services under the name WholeLifeFit and specialises in women’s fitness coaching and bikini body shape. 

Barbora will use her skills and knowledge to achieve and support client goals. 

The client understands that the results of clients may differ and depend on the client’s efforts, cooperation and communication with Barbora, as well as on the purchased program.

The Client Obligations

Anyone who buys a product from Barbora, WholeLifeFit or is provided with any personal or online service becomes a client.

The client understands that she has to come to  personal training and group session ready, dressed in sportswear and bring a water bottle.

The client acknowledges that if she comes to any session or consultation under the influence of alcohol or drugs, no service will be provided.

The client acknowledges that in case of any healthy problems, she is obliged to inform Barbora of this fact before the personal training, group session or consultation. Barbora does not take any responsibility for the damage caused to the client health condition.

The client understands that participating in a training session or a group session is associated with risks. If client suffer or claim to have suffered any injury while attending the training, the client acknowledge that Barbora is not responsible unless the injury was caused by gross negligence or wilful misconduct.

The client acknowledges that in case of health problems, her participation in any training, nutrition program, personal training na group session must be consulted with the GP. Barbora can not be held liable in any way for undeclared or unknown medical conditions.

Personal Training 

Personal training is 1:1 session attended by one client and Barbora. The personal training is focused on building a bikini body shape. 

Personal training is provided as a 50-minute session or as a 30-minute session. The 50-minute session is designed as a weight training. The 30-minute session is focused on a certain body part or a specific problem.

Training sessions are provided from 7 o’clock in the morning.

The client acknowledges that the personal training does not serve as a substitute for health care. The client acknowledges that she may not enter the personal training if she suffers from serious health problems.

Group Sessions

Group session are sessions are designed as circuit trainings and are provided for a maximum of 5 women per one session. The session is focused on building a bikini body shape.

The group session consists of 8 exercises performed in 4 rounds. The exercises are practiced for 45-seconds and followed by an 8-second pause between exercises. There is a 53-second pause after each round. 

Group lessons are held on Mondays, Wednesdays and Fridays at two times: 7:10-7:50 am and 9:10-9:50 am.

The time and day can be changed at any time according to business preferences.

The client acknowledges that the group session does not serve as a substitute for health care. The client acknowledges that she may not enter the group session if she suffers from serious health problems.

Nutrition and Training program 

The nutrition and training program is a 4 weekly personalised service provided for a minimum period of eight weeks in a row. 

Nutrition and training programs will be delivered to the client within 7 working days of payment. The following programs will be delivered to the client every 4 weeks after payment and after check.

The client acknowledges that it is the client’s obligation to comply with the check within the regular deadlines, which are specified in the client’s plan, with all the requisites and without prompting.

The client acknowledges that in case of non-delivery of the regular check, communication and any assistance will not be not provided. 

If the check is not delivered before the next payment, the client will be deducted payment for the service in due time. The next program will be delivered later, after check within 7 working days and will be designed for 4 weeks. The payment will continue on a regular monthly basis, which may cause inconsistencies in the payment and the service provided.

The client acknowledges that if client does not meet the check deadline or does not communicate, she must be aware that the regular payment will continue in due time unless she requests the cancellation of the program. The client will not be provided with any refund for lost time or any program or compensation for this lost time.

Each client is provided with a regular weekly check within the program. This check is provided as a 20 minute check online or in person. The client will be asked to answer questions about the plan and adherence to the program, her progress, her weight, measurements and photos. The client must be prepared in the event of a personal check that she may be required to take a picture.

It is not possible to request an extension of the program due to illness, nausea, family or other personal problems, and other reasons during which the program was not followed. The program is always designed for 4 weeks.

The client acknowledges that the nutrition and training program does not serve as a substitute for health care. The client acknowledges that she may not enter the program if she suffers from serious health problems.

The client is fully responsible for fulfilling client’s obligations to Barbora as Barbora focuses on providing personalised service at a high standard.

Webinars 

The purpose of webinars is to enrich client information that they can use in their daily and fitness lives. Webinars are by no means a substitute for health care or a solution to health problems.

It is not possible to request a refund for webinars or any other compensation.

Purchasing Sessions and Services 

Nutrition and training program, webinars and workshop purchases are made online at www.wholelifefit.com via Stripe payment gateway. 

Personal training, group session purchases are made via Stripe payment link sent by Barbora or online at www.wholelifefit.com.

Prior to payment, the client must make sure that client is at the correct address www.wholelifefit.com or that Stripe has received a payment link sent just by Barbora and has not been redirected to any other unreliable site to avoid the scam or misconduct on the Internet.

Group sessions and personal trainings are sold as a weekly package with a specified number of sessions. It is assumed that the client will use it in its entirety in the given number of sessions.

Bookings

Session bookings must be arranged directly with Barbora. 

A verbal or written agreement directly with Barbora, entered in the booking diary, is considered a booking of the service in case of personal trainings.

Group lessons are automatically booked for the same time and the same number of lessons according to the purchased package.

Group lessons always take place on Mondays, Wednesdays and Fridays in the first time 7:10-7:50  am and in the second time 9:10-9:50 am.

Payments

All payments must be made in full prior to any sessions or any service provided and are charged in NZD.

All payments are provided by the Stripe payment gateway.

By purchasing the product, the client agrees to the automatic payment deducted from client’s account, regularly on the same day of the month. 

The payment is made weekly for personal training or group sessions, regularly on the same day of the month.

The payment is made 4 weekly for nutrition and training programs, regularly on the same day of the month.

Payment is made once in the case of online webinars and workshops. 

Each late payment is automatically charged fee of $ 10

If a client requests training during the weekend, client will be charged a $ 1/2 of the training price above the training price. Weekend training is only possible if Barbora becomes available.

Personal Training Cancellations and Fees

Barbora require a minimum of 24 hours notice of any cancellation of any personal training. It can be done by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number. The call or spoken communication not considered a cancellation.

If the client do not provide at least 24 hours notice for any reason, the client lose this personal training and client’s money will not be refunded or any other compensation will not be provided.

In the event of termination of the use of personal training, the client is obliged to notify the cancellation 14 days in advance. The day of payment and the day of the request for cancellation of the service fall within these 14 days. 

The weekly number of personal trainings must be used in week days and the payment will be canceled. If the client does not use her number of trainings, the client will not receive a refund or any compensation.

Re-bookings of personal trainings can be requested more than 24 hours in advance and are subject to a fee of $10 for each re-booked training session. This amount will be automatically deducted from the client’s account.

The client is responsible for the proper cancellation of personal training and in case of non-cancellation of personal trainings, the regular payment for the service will continue and it is not possible to request a refund or any other compensation. 

In the case of holiday, sickness or isolation suspensions of personal training may be applied for a maximum of 2 weeks and must have an end date. This period cannot be counted towards the deadline in case of cancellation of personal trainings. The period of 2 weeks for the cancellation of personal trainings runs after the resumption of trainings.

Each refund will be reduced by the amount charged by the Stripe Service Provider. The client must acknowledge that the client’s payment is reduced by the Stripe’s fees for both actions performed, both for payments and for refunds.

Group Session Cancellations and Fees

Barbora require a minimum of 24 hours notice of any cancellation of any group session. It can be done by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number. The call or spoken communication not considered a cancellation.

If the client do not provide at least 24 hours notice for any reason, the client lose this group session and client’s money will not be refunded or any other compensation will not be provided.

In the event of termination of use of the group sessions, the client must notify her cancellation 7 days before the next payment. If the service is canceled less than 7 days, the service will be canceled after the next payment. The day of payment and the day of the request for cancellation of the service fall within these 7 days.

Re-bookings of a group session can be requested more than 24 hours in advance and will be allowed if there is a free space for the next session. The group session can be re-booked for any following 3 sessions, which take place in regular times. The session cannot be re-booked later than the next 3 following sessions.

The client is responsible for the proper cancellation of group sessions and in case of non-cancellation of group sessions, the regular payment for the service will continue and it is not possible to request a refund or any other compensation.

In the case of holiday, sickness or isolation suspensions of group sessions may be applied for a maximum of 2 weeks and must have an end date. This period cannot be counted towards the deadline in case of cancellation of group sessions. The period of 2 weeks for the cancellation of personal trainings runs after the resumption of group sessions.

Failure to attend the meeting will not result in a refund or other compensation.

Nutrition Program Cancellations and Fees

The nutrition program is subject to a minimum cooperation period of 8 weeks from the first payment.

Cancellation of the nutrition program is subject to at least 7 days notice before the next payment. It can be done by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number. The call or spoken communication not considered a cancellation.

The client is responsible for the proper cancellation of nutrition program and in case of non-cancellation of nutrition program, the regular payment for the service will continue and it is not possible to request a refund or any other compensation.

The client is obliged to communicate regularly with Barbora about her progress during the time set aside for the check, which is stated in the plan. 

If the client does not communicate with Barbora, no program or assistance will be provided. 

The client acknowledges that the next program can only be created on the basis of an end-of-month check. If the check is not made, the payment will be charged automatically and the client will not receive new program.

It is not possible to request a refund, extend the monthly period nor request another compensation for a check failure.

It is not possible to request an extension of the program or refund due to illness, nausea, family or other personal problems, health problems and other reasons during which the program was not followed.

Training Program Cancellations and Fees

The training program is subject to a minimum cooperation period of 8 weeks from the first payment.

Cancellation of the training program is subject to at least 7 days notice before the next payment. It can be done by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number. The call or spoken communication not considered a cancellation.

The client is responsible for the proper cancellation of training program and in case of non-cancellation of training program, the regular payment for the service will continue and it is not possible to request a refund or any other compensation.

The client is obliged to communicate regularly with Barbora about her progress during the time set aside for the check, which is stated in the plan. 

If the client does not communicate with Barbora, no program or assistance will be provided. 

The client acknowledges that the next program can only be created on the basis of an end-of-month check. If the check is not made, the payment will be charged automatically and the client will not receive the program.

It is not possible to request a refund, extend the monthly period nor request another compensation for a check failure.

It is not possible to request an extension of the program or refund due to illness, nausea, family or other personal problems, health problems and other reasons during which the program was not followed.

Lateness

If the client is late for any  online or in person session or consultation, the session or consultation will be reduced in accordance with that time. 

If the client is more than 15 minutes late, the session or consultation will be cancelled and the client lose that session, in which case no refund will be made.

Late Payments

A late payment is any payment for any provided service that has not been paid on a regular date which are caused by insufficient amount in the client’s account or any account problem. 

Each late payment will incur a fee of $ 10.

Late payments do not include late payments due to holidays that the bank could not process.

Disclaimer

No services provided by Barbora serve for treatment or as a substitute for medical care.

Barbora is not liable for any injuries or damages caused by no proper form, not train with proper technique, unpreparedness for training, not warming the body before training on personal training, group session or by following training program. 

Barbora is not responsible for any health problems that occur at the client during the cooperation and use of any service.

By using the Garage gym services, the client agrees to exercise at the Garage gym at her own risk. Garage gym is a place designed for personal training, group sessions, client check, consultations. Garage gym is located at 4 Onslow Road, Lake Hayes Estate. It is a garage in a rented family house, in addition to the garage, the garden and the access road to the house are also used for activities. 

Social Networks and Website Promotions

By using services and sessions, the client agrees with Barbora’s right to create media content, photos, videos on which the client can be captured and distribute media such as corporate Instagram, Facebook, websites, emails, online and print ads to promote the business for lifetime. 

The client agrees to the publication of its progress, which can be promoted by photographs, news from the client, reactions on social networks for the purpose of promoting the business for lifetime. 

Barbora uses the social network Instagram, where she has an established profile under her name wholelife_fit, Facebook Wholelifefit – women’s fitness coach and web site www.wholelifefit.com. Barbora reserves the right to change these names.

If the client do not agree with the promotion, the client must notify Barbora in writing by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number. The call or spoken communication not considered as disagreement.

The client acknowledges that by contacting Barbora on social networks Facebook, Instagram or www.wholelifefit.com website, this communication does not have to be private, due to the access of other persons to the social networks who cooperate in their creation or management of social networks. 

Communication is recommended by email bhwholelife@gmail.com, or WhatsApp number 027 347 0976, or text to this number.

Barbora is not responsible for any unreasonable behaviour on the Internet, for scams, making copies or stealing content from her social networks or from her website.

Barbora strives to keep all her content on social networks and websites safe as well as all client data. 

Barbora undertakes never to misuse information about clients, to humiliate them or to abuse their reputation, but to be proud of their progress and to promote them positively.

Barbora reserves the right to change these conditions according to business progress at any time.
